Where the line
actually is.

1 · Privacy and recording

You must not use Hearby to:

• Record, intercept, or process audio of another person without that person’s consent in any jurisdiction that requires the consent of all parties — including California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, Washington, and others.
• Bypass, disable, or attempt to defeat the Disclosure Mode announcement when located in a two-party-consent jurisdiction.
• Capture conversations in any setting where a reasonable person would expect privacy — bathrooms, locker rooms, doctor’s offices, attorney-client meetings, religious confessionals, therapy rooms, and the like.

2 · Decisions about other people

You must not use any Hearby output to make decisions about another person regarding:

• Employment, hiring, firing, promotion, or compensation
• Credit, financial services, or insurance
• Housing or tenancy
• Government benefits
• Any other purpose covered by the U.S. Fair Credit Reporting Act or analogous laws

3 · Professional advice

You must not represent any Hearby output as legal, medical, financial, tax, or psychological advice. Hearby is a conversational assistant, not a licensed professional. Whispers are suggestions. Treat them that way.

4 · Harm to others

You must not use Hearby to:

• Defraud, deceive, or impersonate any person
• Stalk, harass, intimidate, or surveil any person
• Generate content designed to harm, threaten, or discriminate
• Facilitate illegal activity
• Generate content that is hateful, sexually explicit, or violent

5 · Technical abuse

You must not:

• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated means (bots, scrapers, headless clients) to access the Service except via published APIs
• Circumvent rate limits, authentication, or other security measures
• Distribute malware, viruses, or other harmful code via the Service
• Impersonate Hearby personnel or any affiliate

6 · Service integrity

You must not:

• Resell, sublicense, or commercially redistribute the Service without written permission
• Use the Service to build a competing product
• Submit false or misleading information to circumvent abuse controls

7 · Reporting abuse

If you believe another user is violating this policy, tell us. Email abuse@hearby.co with:

• A description of the conduct
• The date, time, and approximate location (if known)
• Any supporting evidence you can share without violating someone else’s rights

We read everything that lands in that inbox. We don’t guarantee a specific outcome for every report, but we do guarantee a human looks.

8 · Enforcement

Violation of this policy may result in:

• A warning
• Suspension of your account
• Termination of your account without refund
• Legal action where the conduct is unlawful
• Cooperation with law enforcement where required by law

We may take enforcement action with or without prior notice depending on severity. The bigger the harm, the faster we move.

9 · Changes

We may update this policy. Material changes will be announced in-app and by email with at least 30 days’ notice.
